The father of Cody Weir's partner was playing the poker machines, with his partner and his other daughter, on September 9 about 8pm.

Albury Local Court heard on Monday that the father saw Weir, stood up, approached him and "words were exchanged".
Weir, 26, who pleaded guilty to affray, swung a punch at left side of the older man's head.
The pair grabbed each other, then Weir pulled away and took a step back.
The older man ran at Weir, wrestled with him and threw him to the floor.
Again, Weir stepped back and then the other man punched him to the face.
Magistrate Richard Funston placed Weir on a conditional release order, without conviction.
