Lee Nugent struck his partner of five years four times in a fit of rage stemming from jealousy.
The 40-year-old had became so aggressive, Albury Local Court has been told on him pleading guilty to assault, simply because the victim was spending time with her adult daughter.
The victim had just returned to their Sunshine Court home on August 23 about 3.30pm after dropping her daughter off at another location.
The assault then inflicted on the 41-year-old victim came just four days after an apprehended violence order she had previously taken out against Nugent had expired.
Defence lawyer Camille McKay said that while Nugent did have some relevant history of domestic violence, this was not extensive.
She said the legal threshold for a jail sentence had not been crossed.
"He was co-operative with police, had made admissions," she said.
N OTHER NEWS:
Magistrate Miranda Moody agreed with Ms McKay's submission that a community corrections was most appropriate.
But she said it was essential that this include the condition that Nugent be subject to supervision, especially in relation to any domestic violence-related courses that NSW Community Corrections might want him to complete.
Ms Moody told Nugent that he simply had to stop perpetrating such violence.
"I mean, slapping a woman on the back of the head like she's a rag doll, it's not on," she said.
Police said Nugent began abusing the victim soon after she returned home from time with her daughter.
The aggression stemmed from her "helping her daughter and not (being) at home with him".
She walked into her bedroom, but Nugent followed. He again yelled at her, then used to palm of his hand to push her forehead.
This was with such force that her head slammed into a wall. Soon after he struck her to the back of head.
The order will run for 12 months.
