His defence argued the eight months Edward Allan Tindle, 66, had already spent in custody without his case proceeding was denying him natural justice.
Practice notes dictate that cases should proceed within a six-month period.

But magistrate Richard Funston said it had to be accepted the matters involving Tindle, his wife and another accused were complex.
Also, the DPP had only become involved in the case in February.
Nevertheless, he accepted the defence argument that Tindle could not properly prepare his case while behind bars.
Tindle is fighting charges including supplying a commercial quantity of cannabis leaf and dealing with the proceeds of crime in relation to $1 million in Australian currency.
He and his wife, Anecita Empasis, had their cases adjourned to June 15.
