Thief who burgled Myer and stole flash perfume still in jail, 'going nowhere'

Albury magistrate Richard Funston has agreed to a defence submission that a pre-sentence report be carried out on the man.

But Mr Funston warned in Albury Local Court on Monday that this did not mean Matthew Andrew Daniel was facing a non-custodial sentence.

He pointed out that Daniel was on an intensive corrections order when he broke into Myer late on the night of June 7.

Defence lawyer Mitchell Brooks entered a plea of guilty on Daniel's behalf to a charge of aggravated break and enter dwelling in company and steal.

Technical issues prevented Daniel, 28, of Thurgoona Street, from appearing via a video link to jail.

Mr Funston said Daniel was placed on the one-month ICO - considered by the court as a sentence of custody served in the community - on May 18, so he had breached the order.

"It may be he's going nowhere fast, anyway," he told Mr Brooks.

"I don't know how a sentence assessment report is going to help Mr Daniel.

"I think it's pretty clear that Mr Daniel is facing a jail sentence."

CCTV footage captured Daniel and his accomplice in David Street at 11.24pm.

They rode bikes to the Myer entrance, remained there for a couple of minutes and then rode away along the footpath, entering the Myer Centre outdoor car park.

Five minutes later, CCTV footage had them in the car park and foyer of the SS&A Club. Daniel was seen pulling out a hammer from the back of this pants to show to his accomplice.

They walked to Myer just before 12.30am and smashed a lower glass panel on one of the two automatic entrance doors.

Their haul, with a retail value of $2392.88, included designer perfume and sunglasses and miscellaneous clothing, some of which was abandoned when a paper bag containing their stash broke, spilling the contents to the ground.

Daniel will be sentenced on August 2.
