Police will allege a car was observed driving erratically in Benalla just after midnight.

Once pulled over the driver returned a positive roadside breath test and was taken to Benalla police station, where an evidentiary breath test showed he had a BAC of 0.153.
Police suspended the man's licence and impounded his car for 30 days at a cost of $1625. He will appear in court at a later date.
