Rasta Kemp died at D&R Henderson in Benalla on May 30, 2019, after being pulled into a rotating shaft and pinned against a metal upright.
"The family is having this matter dragged out," prosecutor Simone Tatas told the Wangaratta Magistrates Court on Thursday, and urged the case be heard as soon as possible.

Magistrate Peter Dunn said the matter would return on September 23.
"The prosecution in my view is quite correct in saying that there are other people who are most interested to have this matter resolved and the longer it drags on the more discomfort it inflicts upon other people," he said.
