But with time already served since his arrest, Damian Francis Boland will immediately become eligible for release.
IN OTHER NEWS:
Magistrate Richard Funston handed the 38-year-old, formerly of Port Augusta in South Australia, one-month jail on each of two charges of assaulting police on June 19.
His offending brought to the attention of police his outstanding charges from 2005 and 2006 of assault, two counts of failing to appear on bail, larceny and break and enter, for which he was put on a nine-month community corrections order.
Mr Funston warned Boland, who appeared in Albury Local Court on Monday via a video link to jail, that if he spat at police again he would be jailed.
"It's a filthy charge isn't it, to assault police by way of spitting?"
Defence lawyer Mitchell Irwin said Boland felt genuine remorse.
