Magistrate Richard Funston had told Dylan Perinoni quite clearly that he was not going to be released from custody.

But several minutes later, the 25-year-old still asked: "So, am I going to be released today?"

Perinoni became visibly upset on Monday when told he wasn't, and that he would remain in custody for at least another six weeks.

Mr Funston said it was crucial for him to find out why Perinoni would behave in such a way.

His victim, Albury Local Court heard, was walking with friends along Dean Street about 2.40am when Perinoni crossed the road and punched him to the ground, leaving him with a heavily bleeding split lip.

"I want to find out why Mr Perinoni just lashes out at people unprovoked," Mr Funston said.

"There's something absolutely serious going on."

Mr Funston ordered a sentence assessment report on Perinoni, of Birdie Street, after he pleaded guilty to a single charge of assault occasioning actual bodily harm.

Perinoni, who appeared via a video link to Albury police station, told the court he suffered from attention-deficit hyperactivity disorder and had Asperger's syndrome.

He said the combination of drinking alcohol and these conditions meant his behaviour could easily get out of control.

"I know I've made a mistake," Perinoni said.

"And I know going to jail will make me worse."

Mr Funston told Perinoni that the pre-sentence report could very well result in him imposing an intensive corrections order, though this was, for now, only a possibility.

"At this stage, you're not looking good," he said.

"Even with special needs you can't just cross the road and do something like that."

Defence lawyer Sascha McCorriston had submitted that Perinoni could be freed on bail with strict conditions.

"It's clear that alcohol was a factor in this matter. It is conceded at the outset that it is a very, very serious offence."

Perinoni will be sentenced on October 25.
