Albury man didn't want to be strip-searched, struggled and eventually bit officer

Instead of complying with the direction, Bailey Peterson took off his jumper, threw it at another officer and sat on a bed in a cell.

When he continued to refuse to do as he was told, the officers took hold of Peterson in order to restrain him.

Peterson struggled, during which his head struck the forehead of the victim.

His conduct on August 12 has led to him being sentenced in Albury Local Court to 12 months' jail, to be served by way of an intensive corrections order in the community.

Peterson, 23, of Thurgoona Street, Albury, pleaded guilty to assault law enforcement officer and inflict actual bodily harm and an unrelated charge of resist police.

Magistrate Richard Funston said he found it "troubling" that Peterson would say, as outlined in his sentence assessment report, he did not need any treatment for drug addiction given the role that methamphetamine played in his offending.

Defence lawyer Mitchell Brooks said Peterson began using illicit drugs at the age of 12, moving on to methamphetamine at 20.

"He's quite aware of the impact they have had in terms of his offending," he said.

Mr Brooks submitted that an intensive corrections order was the most appropriate course given the need to protect the community and, importantly, assist with Peterson's rehabilitation.

He would move to Moama to get away from bad "influences" in Albury.

The court heard how the victim at one point grabbed hold of Petersen, felt immediate pain and said: "He just bit me."
