AUTUMN CASH CODE - TERMS AND CONDITIONS

  1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. Subject to clause 3, entry is open to all residents of Australia, excluding South Australia, aged 18 years or older with a current Australian bank account.
  3. Directors, management, employees, officers and contractors (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. 
  4. Promotion commences on Monday 27th February 2023 at 00:01 AEDT and closes on Sunday 28th May 2023 at 23:59 AEST (“Promotional Period”) however, the eligible Registration Period for each Major Prize Draw will commence and conclude on the following dates and times:

  5. To enter, eligible entrants must, during the Promotional Period:
    a) Purchase a copy of any of the participating printed newspaper publications stipulated in clause 6; OR
    b) Access the Digital Print Edition (Today’s Paper), as part of the entrant’s digital subscription, of any of the participating digital print edition websites stipulated in clause 7.
    c) Locate the weekly codeword within the publication and send an SMS to 0447 116 784 with one of the valid codewords for the corresponding registration period, the entrants’ full name and full address including suburb and state (“Valid Entry”) (Standard message rates apply. Ansible Pty Ltd SMS Helpline is 1300 851 419).  
  6.   8. For clarification, a new weekly codeword will be published in the printed newspapers and digital print editions (today’s paper) stipulated in clauses 6 and 7 from each Monday of the registration period.
  9. In the unlikely event that a weekly codeword is not published in any of the participating publications and/or websites, the valid codeword will be published on the corresponding publications’ social media platform.
  10. Entrants are permitted to submit one (1) entry per person (phone number) per codeword. Entries containing a codeword that does not correspond to the Registration Period in which the entry was submitted will be deemed invalid. For clarification, as stipulated in clause 4, entrants submitting an entry in Registration Period 1 can use any of the week 1 – 5 codewords to be deemed a valid entry, entrants submitting an entry in Registration Period 2 can use any of the week 6 – 9 codewords to be deemed a valid entry, and entrants submitting an entry in Registration Period 3 can use any of the week 10 – 13 codewords to be deemed a valid entry.
  11. All entrants who enter during a Registration Period will be entered into the Major Prize Draw corresponding with the Registration Period in which they entered.
  12. Entries do not carry over between Registration Periods. Entrants must submit an entry within a Registration Period, stipulated in the table in clause 4, to be in the running for the corresponding Major Prize Draw within that Registration Period.
  13. Each SMS entry will be charged at the standard text message rate as dictated by the individual’s phone plan and is the responsibility of the individual (Ansible Pty Ltd SMS Helpline 1300 851 914).
  14. All entrants who have submitted an entry in accordance with clause 5 may receive a bounceback SMS confirming their entry into the competition. If entrants do not receive a bounceback SMS to confirm their entry and they have entered during the competition period and in accordance with clause 5, their entry will still be submitted into the corresponding draw.
  15. Entries must be received by the date and times stated in clause 4. The time of entry will in each case be the time the SMS message is received by the Ansible Pty Ltd database and NOT at the time of transmission by the entrant. SMS entries via the internet or computer generation are invalid and will not be accepted.
  16. Incomplete or indecipherable entries will be deemed invalid.
  17. As stipulated in clause 10, entrants are permitted to submit one (1) entry per person (phone number) per codeword. Any attempts to enter more than once per person per codeword will be deemed invalid and will not be entered into the corresponding Major Prize Draw
  18. Each winner is only eligible to win one (1) Major Prize for the entire competition period
  19. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  20. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  21. There will be three (3) Major Prize Draws, one (1) per Registration Period. There will be three (3) Major Prize Winners in total, with each Major Prize Draw selecting one (1) Major Prize Winner at random. All Major Prize Draws will be held at Ansible Pty Ltd, Level 3, 100 Chalmers Street, Surry Hills NSW 2010 on the dates stipulated in the table below.

  22. Each Major Prize Winner will be notified by the Promoter via phone and email within twelve (12) working days of the corresponding Major Prize Draw, including instructions on how to claim their prize.
  23. The Promoter and Ansible Pty Ltd reserves the right to draw additional reserve entries and record them in order in case of an invalid entry or ineligible entrant. 
  24. This is a game of chance and skill plays no part in determining the winners.
  25.   27. All reasonable efforts will be made by the Promoter to contact the Major Prize Winners. In the event of an unclaimed Major Prize, an Unclaimed Prize Draw will take place on the dates stipulated in the table below, corresponding to the Major Prize that is deemed unclaimed.

  28. Unclaimed Prize Winners will be notified by the Promoter via phone and email within twelve (12) working days, including instructions on how to claim their prize. Winner name(s) will be published in the publications listed in clause 25 by the dates stipulated below:

  29. The Promoter’s decision is final and no correspondence will be entered into.
  30. The Promoter may in its absolute discretion deem entries invalid subsequently to a winner being notified or a winner’s name being announced if it is discovered that the winner did not enter the Competition in accordance with these Terms and Conditions. In these circumstances, the Promoter will revert to a reserve entry drawn (if reserves had been drawn), or otherwise conduct a redraw.
  31. The three (3) Major Prize Winners will each receive the following prize:

  32. Once each Major Prize Winner has been notified of their prize by the Promoter and accepted their prize, they will be contacted by Ansible Pty Ltd via e-mail to organise prize fulfillment. Major Prize Winners must deal directly with Ansible Pty Ltd to handle prize fulfillment.
  33. The prize monies comprising the Major Prizes will be transferred to the Major Prize Winners nominated Australian bank account via EFT.
  34. Major Prize Winners will be required to provide valid identification to Ansible Pty Ltd to prove they meet the valid entry requirements. Winners will also be required to provide their required bank account details to Ansible Pty Ltd in order to facilitate the EFT transfer. Once a Winner has provided all required details, prize fulfillment will be conducted within 15 business days.
  35. It is the responsibility of the Major Prize Winners to provide correct bank account details to Ansible Pty Ltd. The Promoter and Ansible Pty Ltd take no responsibility for misdirected or lost prizes.
  36. Independent financial advice should be sought as tax implications may arise as a result of accepting a prize.
  37. If for any reason the winner does not take the prize (or an element of the prize) at the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
  38. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to the directions of any regulatory authority.
  39. Total prize pool value is up to $30,000.00. Prize, or any unused portion, is not transferable or exchangeable, unless otherwise specified.
  40. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  41. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate, subject to the directions of any regulatory authority.
  42. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
  43. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  44. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.
  45. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. The Promoter will otherwise collect, hold, use and disclose PI as set out in its Privacy Policy, which can be viewed at https://www.acmadcentre.com.au/privacy/. All entries become the property of the Promoter.
