The fire burnt about 5200 acres in December 2009 and destroyed five homes after starting at the Walla tip.
Gerogery woman Sharon Patricia Weber led the class action with 57 people after losing her home, and argued the Greater Hume Shire breached its duty of care to residents.
Six possible causes of the fire had been identified, but Justice Michael Walton said the cause could not be determined, which resulted in the action failing.
The matter was dismissed in the NSW Supreme Court in May but lawyers recently lodged an appeal.
Kathryn Emeny of Maddens Lawyers said a notice of intention to appeal was lodged to the court, with further details required by August 14.
