A Lavington man who threatened arresting police with a knife and also smashed in the back windscreen of a rental car with a golf club as a child sat inside has escaped jail.

Magistrate Rodney Brender told Luke Anthony Tyrell in Albury Local Court on Friday that legislation precluded him from imposing such a sentence.
That was because he was already serving a five-year and three-month jail term imposed by the District Court.
Tyrell - who committed one of the more recent offences while on parole for the District Court matters - is not due for release from Junee jail until October 8.
Mr Brender said he simply could not impose a jail term - either fully or partly consecutive or cumulative regardless of whether Tyrell's original release date of March or more recent release date of October was applied.

In the end, he sentenced Tyrell, 25, to lengthy community correction orders.
Mr Brender said these at least served the purpose of both punishing and rehabilitating Tyrell.
Tyrell, appearing via a video link to jail, sat with his head downcast as Mr Brender delivered his sentence, delayed since Monday.

He was given a two-year order and fined $500 on charges of destroy or damage property, over the car window incident that stemmed from an argument over money, and fail to appear on bail.
A three-year order was imposed for using an offensive weapon to prevent lawful detention and resisting police.
These charges related to an incident on February 6 when police, armed with three arrest warrants, went to Tyrell's Woomera Crescent home.
Tyrell hid behind a shower curtain as police searched his house, pulling out a large knife when they found him in the bathroom and first holding it to his throat then pointing the knife at one of the officers.
He got another two-year community corrections order on a final, unrelated charge of resisting police, where police had to use capsicum spray to subdue him.
Tyrell had a history of substance abuse, mainly methamphetamine, and turned to violence as a coping mechanism.
