Defence lawyer Laura Melhuish said Kristy Lee Crupi's actions fell just below the mid-range for objective seriousness.
"But the damage and injuries ultimately caused were not significant," she said.
Ms Melhuish said that meant the threshold for jail had not been crossed.
The submission stunned magistrate Tony Murray.
"Seriously? Why?" he replied to Ms Melhuish, who said the victim's injuries only involved bruises and scratches.
MORE COURT STORIES:
Mr Murray said Crupi's offending easily crossed the threshold for time in custody though it would be by way of a 12-month intensive corrections order rather than a jail cell. He also fined her $300.
"Do you understand this?" Mr Murray asked her. " This is one step before jail."
Crupi, of Kotthoff Street, pleaded guilty to assault occasioning actual bodily harm, common assault, contravention of an apprehended violence order and destroy or damage property.
That was over matters that were revealed on February 2.
Police attended Albury hospital that day about 2.30pm after receiving a report of the victim being assaulted by Crupi.
The pair had been in an on-off relationship for about two years, but by then the victim had an apprehended violence order in place against Crupi.
"The victim and the accused have been spending the past few days together," police said of their pair's relationship status at the time.
The victim couldn't remember who initiated the contact between the pair, who had gone back to his home in Andrews Street, East Albury.
"At some point during the night an argument has started between both parties which has turned violent," police said.
"The victim has run off towards the hallway and closed the door behind him. The accused has followed and kicked the door, causing the locking mechanism to break."
Crupi then grabbed the victim by the throat and pushed him back towards the wall, while also kicking him in the leg and scratching his neck."
To get away from Crupi, the victim went to the garage but she followed then attacked him again.
Crupi was arrested while hiding in her back yard nine days later.
