"Anybody who commits domestic violence while on a community corrections order for domestic violence with the same complainant is facing a jail sentence," he said.
The court has heard how Irwin grabbed his partner by the hair and pulled her off a couch to her knees.
Nugent was handed a nine-month jail sentence, by way of a supervised intensive corrections order, must complete 150 hours of unpaid community work and was ordered to complete the men's behavioural change program.
But the 40-year-old Lavington man appeared to show little attention to his sentencing by Mr Funston, asking him only: "Am I getting out today?"
Nugent, of Sunshine Court, pleaded guilty via a video link to Junee jail to charges of common assault and contravention of an apprehended violence order.
The court was told that Nugent and his partner began arguing on March 24 over his belief she spent too much time taking her son to a sporting match.
She decided to ignore him for the rest of the night.
The next day about 12.45pm he resumed the argument, abused her and pulled her off the couch by her hair.
She immediately reported the assault to police.
