The burger makers and a next-door service station shut in 2012 when a business downturn on Wagga Road struck.
A development application for a standalone Hungry Jack's at 375 Wagga Road has been lodged with Albury Council with plans for a 24-hour service station on the corner of Kaylock and Wagga roads revealed two years ago still to proceed.
The fast-food outlet plans estimated at $900,000 have been lodged on behalf of development group BDAI.
They include proposed operating hours of 6am to midnight, seven days a week with 40 staff in a mix of full-time and casual positions once opened.
The restaurant's overall capacity is 54 seats with 40 seats provided internally and 14 outdoors.
A total of 29 car-parking spaces have been proposed for the site which is presently vacant.
"The Hungry Jack's restaurant is a destination land use accessed via Wagga Road and is not inconsistent with the mixed land use nature within the Lavington mixed use precinct," the development application states.
"It will not result in any adverse impacts to neighbouring non-sensitive mixed use properties.
"The key to the project is how appropriate is the building design and how is its visual impact ameliorated."
The former Hungry Jack's stores in the city on Wagga Road and Hume Street suffered massive downturns in trade when the internal freeway opened in the mid-2000s.
Hungry Jack's has opened a new store on Hume Street opposite McDonald's.
The $3.5 million proposal was lodged earlier this year.
