That is rather than having Cody Smith's matters prosecuted in the courts over the incident, in which it is alleged he also punched a 78-year-old man in the face before throwing him to the ground.

Smith, 30, is facing four charges of assault occasioning actual bodily harm over allegations he attacked several people in Albury's CBD on July 5.
After his arrest and charging, Smith was admitted as an involuntary patient at Albury hospital's mental health unit, Nolan House.
He remained there for three weeks and successfully applied for bail in late July after Albury Local Court heard his condition had stabilised since he resumed his monthly depot injections.
Defence lawyer Camille McKay said she anticipated there would be "a number of Section 32 applications" when Smith's matters were mentioned on September 16.
